Pursuant to a complaint received, CAD commenced investigations against Jasvendar Kaur D/O Avtar Singh for possible offences of unauthorised person acting as advocate or solicitor under Section 33 of the Legal Profession Act Chapter 161 (LPA).
Investigations revealed that Jasvendar, whose last Practising Certificate, was valid from 1 April 2004 to 31 March 2005, continued to practise as an advocate and solicitor under M/s Jyah and Jas Advocates and Solicitors despite the expiry of her Practising Certificate.
She had, since the expiry of her Practising Certificate, appeared in the Subordinate Courts as an advocate and solicitor on 6 different occasions and sent out a total of 36 letters implying that she was duly qualified and authorised to act as an advocate and solicitor. She was thus charged for 6 counts of offences under Section 33(1)(a) and 36 counts under Section 33(1)(b) of the LPA.
When Jasvendar appeared in the Subordinate Courts at a pre-trial conference before District Judge Yeow Ping Lin (District Judge Yeow) on 1 June 2005, she confirmed that she was late in applying for her Practising Certificate but has since obtained the Certificate.
This was false. She has furnished false information to District Judge Yeow with the intention to cause District Judge Yeow to omit reporting her to the relevant authorities. As such, Jasvendar was also charged for providing false information to a public servant under Section 182 of the Penal Code Chapter 224.
On 21 September 2006, Jasvendar was sentenced by the Court to a fine of S$ 4,000 and imprisonment of 2 weeks. Following an appeal by the prosecution, her sentence was enhanced by an additional two weeks imprisonment on 17 November 2006.
